This privacy policy is intended to inform users of the
LesVacantes website (hereinafter “the Site”) how their personal data is collected,
used and protected, in accordance with the General Data Protection Regulation (GDPR – EU 2016/679)
and the French Data Protection Act.
1. Data controller

2. Personal data collected
When you use the Site, LesVacantes may collect the following categories of data. Not all of them apply to every User: business and tax data, and proof of ownership, are only requested from Owners.
a) Identification data
- Title, surname, first name
- Date of birth
- Email address
- Telephone number
- Profile photo (optional)
- Languages spoken and usual response time (Owners)
b) Postal details
- Postal address, address line 2, postcode, town, country
- Billing address where it differs from the main address
Your home address is never displayed publicly: it is used to draw up leases, rent receipts and invoices.
c) Proof of identity
- A copy of a national identity card, passport or residence permit
d) Owner status and business data
- The capacity in which the property is let: private individual, company or agent
- For a legal entity: company name, legal form, SIREN or SIRET number, registered office address, the signatory’s capacity
- For an agent: the professional licence number issued under Act no. 70-9 of 2 January 1970, where applicable
e) Supporting documents
- Kbis extract less than three months old (legal entity)
- Management mandate signed by the owner (agent)
- Proof of ownership: title deed, notarial deed or latest property-tax notice
These documents establish the right to let the property and the capacity of the person signing the lease. They are accessible only to the User concerned and to authorised LesVacantes staff.
f) Tax data
- Tax number
- Declared tax regime
- VAT status and EU VAT number where applicable
This data is collected under the reporting obligations that apply to platform operators, set out in articles 1649 ter A to 1649 ter E of the French General Tax Code (implementing the “DAC 7” directive) and detailed in decree no. 2022-1661 of 26 December 2022.
g) Data relating to the rental plan
- Status (owner / tenant)
- Description of the rental plan
- Desired length, period and location
- Type of lease envisaged (civil lease for a property that is not a main residence, or bail mobilité)
- For the bail mobilité only: evidence of the eligibility reason set out in article 25-12 of Act no. 89-462 of 6 July 1989 (employer’s letter, assignment order, internship agreement, apprenticeship contract, proof of enrolment or civic service certificate)
h) Data relating to third parties
- The name of the owner represented, where the Property is offered by an agent
- The name and phone number of the local contact for the key handover, where provided
Users who provide a third party’s contact details undertake to have informed that person beforehand and to pass this policy on to them.
i) Browsing data
- IP address
- Browser type
- Pages viewed
- Cookies and trackers (see section 8)
j) Payment data
LesVacantes does not directly collect or store bank details.
Rent collection and payouts to Owners are handled by our payment services provider, which collects and verifies the Owner’s identity, date of birth and bank details for that purpose.
LesVacantes stores only the identifier of the associated payment account and that account’s verification status, in line with the provider’s privacy policies.
3. Purposes of processing
Personal data is collected for the following purposes:
- Creating and managing user accounts
- Connecting owners and tenants
- Communication about enquiries, introductions and contracts
- Securing the Site and preventing fraud
- Improving the user experience
- Verifying the right to let the Property and the capacity of the person signing the lease
- Drawing up leases, inventories of condition, rent receipts and invoices
- Collecting rent and paying out to Owners
- Complying with the reporting obligations applicable to platform operators (articles 1649 ter A et seq. of the French General Tax Code)
- Complying with legal and regulatory obligations
4. Legal basis for processing
Processing is based on:
- Performance of a contract or of pre-contractual measures
- The user’s explicit consent
- LesVacantes’ legitimate interest (security, service improvement)
- Applicable legal obligations, in particular accounting, tax and reporting obligations
By category of data:
- Identification, contact details, rental plan, mandate and proof of ownership: performance of the contract and of pre-contractual measures;
- Proof of identity and document checks: legitimate interest in preventing fraud and identity theft;
- Tax data: legal obligation (articles 1649 ter A to 1649 ter E of the French General Tax Code);
- Evidence of the bail mobilité eligibility reason: performance of the contract, as the reason must be stated under article 25-13 of the Act of 6 July 1989;
- Non-essential cookies: consent
5. Data recipients
Personal data is disclosed only:
- To LesVacantes’ internal teams
- To the technical providers needed to run the Site: hosting, payment services provider, insurance partner, email delivery, electronic signature
- To the other party to the rental contract, limited to the data needed to enter into and perform the lease
- To the French tax authorities, under the reporting obligations applicable to platform operators
LesVacantes never sells or rents personal data to third parties.
6. Retention period
Data is retained:
- For as long as the user account exists
- Rental contracts and associated documents: five years from the end of the lease, the ordinary limitation period (article 2224 of the French Civil Code)
- Accounting records and supporting documents: ten years from the end of the financial year (article L. 123-22 of the French Commercial Code)
- Tax data and supporting documents: six years (article L. 102 B of the French Book of Tax Procedures)
- Copy of proof of identity: kept only as long as strictly necessary for verification, then deleted, unless a legal retention obligation applies
- Then archived for a maximum of 3 years for legal and evidential purposes
- Browsing data is retained in accordance with the applicable regulations
Users can ask for their account to be deleted at any time.
7. User rights
Under the GDPR, every user has the following rights:
- Right of access
- Right to rectification
- Right to erasure (“right to be forgotten”)
- Right to restriction of processing
- Right to object
- Right to data portability

8. Cookies and trackers
The Site uses cookies in order to:
- Make sure it works properly
- Measure audience and improve performance
- Make browsing easier
On a first visit, a consent banner lets users accept or refuse
non-essential cookies.
9. Data security
LesVacantes implements all appropriate technical and organisational measures to ensure
the security, integrity and confidentiality of personal data, in particular:
- Secure hosting
- Restricted access to data
- Encryption protocols
- Monitoring and regular updates
10. Transfers outside the European Union
As a rule, data is hosted within the European Union.
Where some providers are located outside the EU, LesVacantes makes sure they offer adequate safeguards
compliant with the GDPR.
11. Changes to the privacy policy
LesVacantes reserves the right to amend this policy at any time.
