Cancellation policy

1. Purpose

These Cancellation Conditions set out the rules that apply to the cancellation of a booking made on the LesVacantes.

They supplement the General Terms of Use and Sale and the rental contract entered into between the Owner and the Tenant.

They apply equally to both types of lease offered on the Platform — the bail civil for use as accommodation that is not the tenant’s main residence, and the bail mobilité — it being specified that the rules for terminating a lease in progress differ depending on the contract used (see section 6 below and section 3 bis of the General Terms).

In the event of a conflict between these Cancellation Conditions and the rental contract, the specific provisions of the rental contract prevail as between the Owner and the Tenant.


2. General principle

LesVacantes applies a single cancellation policy to all bookings made on the Platform.

When the booking is confirmed, the Tenant makes the first booking payment equal to the first month’s rent, charges included.

The purpose of this payment is:

  • to confirm the booking definitively;
  • to block out the available dates for the Property;
  • to secure the parties’ mutual commitment until the Tenant moves in.

The first booking payment is made exclusively by bank card, using the secure payment solution offered on the Platform.

It is held temporarily by the payment services provider partnered with LesVacantes until the rental contract takes effect.

When the Tenant moves in, the deposit is set against the first month’s rent due under the lease and then paid over to the Owner.
Making the first booking payment does not immediately transfer the right to occupy the Property.
The sole purpose of the first booking payment is to secure the booking until the rental contract takes effect.

The first booking payment is legally distinct from the LesVacantes service fees and the payment processing fees. The first booking payment is subject to these Cancellation Conditions, whereas the service fees and processing fees pay for services actually performed and costs definitively incurred as soon as the booking is confirmed.

3. Cancellation policy

Cancellations give rise to the following refunds:

Time limits are assessed by the date and time (Paris time) at which the cancellation request is received on the Platform.

4. Cancellation before the lease is signed

Until the rental contract has been signed by the Owner and the Tenant, either party may withdraw from the booking.

Any sums paid are refunded in full, less any bank charges definitively incurred.

The LesVacantes service fees are not payable.


5. Cancellation after the lease is signed and before the move-in date

Signing the rental contract legally binds the Owner and the Tenant on the terms of the lease entered into, whether a civil lease or a bail mobilité.

The financial consequences of a cancellation are determined in accordance with the cancellation policy set out in section 3 of these Conditions.

5.1 Cancellation by the Tenant

Where the Tenant cancels the booking after the rental contract has been signed and before moving in, the deposit corresponding to the first month’s rent, charges included, is refunded or retained as follows:

  • more than 60 days before the move-in date: the deposit is refunded in full;
  • between 60 and 30 days before the move-in date: 50% of the deposit is refunded;
  • less than 30 days before the move-in date: the deposit is not refunded.

The LesVacantes service fees are definitively earned as soon as the booking is confirmed, the introduction, booking, Platform access and associated digital services having been performed.

Les payment processing fees, corresponding to the costs actually charged by the payment services provider for collecting the deposit, holding it temporarily, managing payments and carrying out any refunds, also remain payable and are non-refundable.

LesVacantes plays no part in assessing the reasons for a cancellation or its contractual consequences as between the Owner and the Tenant.

5.2 Cancellation by the Owner

Where a cancellation is attributable to the Owner before the move-in date:

  • the first booking payment is returned to the Tenant in full;
  • any sums paid in respect of the booking are refunded in accordance with these Conditions.

Les LesVacantes service fees et les payment processing fees remain earned in principle, as they correspond to services actually performed and to costs definitively incurred by the Platform.

However, LesVacantes reserves the right to grant, on an exceptional basis and without this creating any entitlement for Users, a partial or full refund, or a credit note — in particular where the cancellation results from an event beyond the Owner’s control, or as part of its commercial policy.

LesVacantes may also temporarily suspend or remove the Listing or the Owner’s account in the event of repeated cancellations or a breach of these Conditions.


6. Cancellation after moving in

From the move-in date onwards, early termination is governed by the rental contract signed between the Owner and the Tenant and by the legal regime applicable to that contract.

Under a civil lease, early termination is only possible on the conditions expressly set out in the contract.

Under a bail mobilité, the Tenant may terminate the contract at any time, subject to one month’s notice, in accordance with article 25-15 of Act no. 89-462 of 6 July 1989. This right is a matter of public policy and cannot be excluded by the contract. Notice is given by recorded-delivery letter with acknowledgement of receipt, by process server, or delivered by hand against a receipt or signature, the period running from the date it is received. The Tenant remains liable for rent and charges for the whole notice period, unless the property is occupied before the end of that period by another tenant, with the Owner’s agreement. The Owner, for their part, has no right of early termination.

It should be remembered that under a bail mobilité no security deposit can have been paid and the flat charges fee gives rise to no reconciliation: no move-out statement can therefore be raised against the Tenant on that basis.

LesVacantes is not a party to the rental contract and plays no part in the financial consequences of such termination.


7. Force majeure

In the event of force majeure as defined in article 1218 of the French Civil Code, the parties are invited to seek an amicable solution.

LesVacantes may facilitate their discussions without acting in their place.

LesVacantes does not rule on any dispute concerning the application of force majeure.


8. Refund arrangements

Where the cancellation conditions give rise to a refund, it is made, as far as possible, to the payment method used for the booking.

How long a refund takes depends on:

  • the payment services provider;
  • the banks involved;
  • technical processing times.

Payment fees definitively charged by the payment services provider may remain payable by the User where they cannot be recovered.


9. Insurance

Some cancellations, interruptions of stay or claims may be covered by the insurance policies offered on the Platform.

Cover, exclusions, excesses and compensation limits are defined exclusively by the general terms of the insurance policy concerned.

LesVacantes is not an insurer.

Taking out the insurance and cover offered through the Platform is optional and is entirely the User’s decision. Insuring the property being let remains the Owner’s responsibility, on the conditions set out in section 10 of the Terms of Sale.


10. The role of LesVacantes

LesVacantes acts solely as a digital intermediation platform.

In that capacity, LesVacantes:

  • facilitates the booking;
  • provides the tools needed to carry it out;
  • facilitates communication between the parties where necessary.

LesVacantes is not a party to the rental contract.

LesVacantes carries out no property administration, rental management or dispute arbitration activity.

The temporary holding of the deposit by the payment services provider partnered with LesVacantes is solely a technical requirement linked to securing the booking and performing the rental contract.


11. Consumer mediation

In accordance with articles L.611-1 et seq. of the French Consumer Code, any consumer may use a consumer mediator free of charge after having sent a written complaint that received no satisfactory reply.

12. Governing law

These Cancellation Conditions are governed by French law.

Any dispute concerning their interpretation or performance falls within the jurisdiction of the competent French courts, subject to the protective provisions applicable to consumers.
